These Terms and Conditions (the Terms) apply when you access or use the Cyber Food Fiji website, mobile applications, ordering platform, customer-support channels, and related delivery services (together, the Platform).
The Platform is operated by Cyber@ge Pte Ltd, trading as Cyber Food Fiji (Cyber Food, we, us, or our), a company incorporated in Fiji.
Please read these Terms before using the Platform or placing an order.
By creating an account, accessing the Platform, or placing an order, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Platform.
If you are under 18, you may use the Platform only with the involvement and permission of a parent or legal guardian. The parent or guardian is responsible for the order and payment.
Cyber Food provides an online ordering and delivery platform that connects customers with participating restaurants, shops, and other vendors (Vendors).
Vendors are responsible for their menus, product descriptions, prices, availability, preparation, packaging, ingredients, and food quality. Cyber Food facilitates ordering, payment where applicable, delivery, and customer support.
Some items from non-partner businesses may be available through an assisted or manual-order service. Different charges and conditions may apply to those orders and will be disclosed before confirmation.
You agree to:
provide accurate, complete, and current account, contact, and delivery information;
keep your login details and verification codes secure;
not impersonate another person or use another person’s account without permission;
promptly tell us if you believe your account has been accessed without permission; and
be responsible for activity carried out through your account, except where caused by our failure to use reasonable care.
We may request reasonable identity or payment verification to prevent fraud, protect customers and Vendors, or confirm eligibility for a payment method. Do not send identification documents through unofficial accounts or channels.
An order placed through the Platform is a request to purchase the selected items and delivery service. An order is confirmed when the Vendor accepts it or when the Platform otherwise shows that it has been accepted.
Before confirming an order, you must check:
the selected items, quantities, and special instructions;
your delivery address and contact number;
the payment method; and
the item prices, delivery fee, service fee, taxes, payment-processing charges, and any other disclosed charges.
Menu items, prices, availability, preparation times, and delivery estimates may change. If a material change is required after you order, we or the Vendor may contact you for approval.
We may decline or cancel an order where an item is unavailable, information is incomplete, payment cannot be verified, the delivery address is outside the service area, the order presents a safety or fraud risk, or the order cannot reasonably be fulfilled. If we cancel a prepaid order, we will arrange an appropriate refund, subject to these Terms and applicable law.
All prices are shown in Fiji dollars unless stated otherwise.
The total displayed before you confirm an order may include:
the Vendor’s item prices;
a delivery fee based on factors such as distance, location, demand, or order type;
a Cyber Food service or assisted-order fee;
taxes; and
a payment-processing or third-party charge, where applicable.
The charges shown at checkout or quoted to you before confirmation apply to that order. We may update fees from time to time, but changes will not apply retrospectively to a confirmed order.
Available payment methods are displayed on the Platform and may include online payment, mobile wallet, electronic funds transfer, EFTPOS, or cash on delivery. Not every method is available for every customer, location, or order.
We may require advance payment or additional verification for selected orders, including some first-time, high-value, cash-on-delivery, assisted, or higher-risk orders. If verification is required, we will explain what is needed before processing the order.
Where cash on delivery is available, you must:
have the full amount ready at delivery, unless another arrangement has been confirmed;
provide accurate contact and delivery details; and
be available to receive and pay for the order.
Cash on delivery may be restricted or removed where there are repeated cancellations, refusals, unpaid orders, false information, suspected fraud, or unsuccessful deliveries attributable to the customer. Any restriction will be applied reasonably and may be reviewed by customer support.
Delivery times are estimates, not guarantees. They may be affected by Vendor preparation time, traffic, weather, road conditions, order volume, address accuracy, safety concerns, and events outside our reasonable control.
You must provide a complete and accessible delivery address, a working phone number, and any instructions reasonably needed to find the location. You must ensure that someone is available to receive the order.
If the courier arrives but cannot contact you or safely complete the delivery, the courier may wait for up to 15 minutes. After that time, the order may be treated as undeliverable. You may remain responsible for the item cost and charges already incurred, except where the failed delivery was caused by Cyber Food, the Vendor, or the courier. A new delivery or replacement order may require additional payment.
The courier may refuse to enter a property or location that is unsafe, unlawful, inaccessible, or outside the agreed delivery point. We may contact you to arrange a safe handover location.
You may request cancellation before the Vendor accepts the order. If the order has not been accepted or preparation has not started, we will normally cancel it and refund any amount paid.
Once the Vendor has accepted the order or started preparing it, cancellation may not be possible because food and other perishable items are prepared specifically for the customer. If cancellation is accepted after that point, reasonable costs already incurred may be deducted where permitted by law and disclosed to you.
For cash-on-delivery orders, repeated cancellation after acceptance may result in cash on delivery being restricted on the account.
Nothing in this section limits any right or remedy that cannot lawfully be excluded under Fiji law.
Contact us as soon as possible if:
your order was not delivered;
you received the wrong item;
an item is missing;
food or another item is unsafe, damaged, materially different from its description, or otherwise not of acceptable quality; or
you were charged incorrectly.
Please provide the order number and, where reasonably required, a description, photograph, receipt, or other information that helps us investigate.
Depending on the circumstances and applicable law, the appropriate solution may be redelivery, replacement, account credit, partial refund, or full refund. We will consider the nature of the problem, the affected item, evidence available, and the roles of Cyber Food and the Vendor.
Approved refunds will normally be returned to the original payment method where practicable. Processing times depend on the bank, mobile-wallet provider, payment processor, or other provider. Any non-refundable third-party charge will be handled only as disclosed and permitted by law.
These Terms do not exclude, restrict, or modify consumer guarantees, remedies, or other rights that cannot lawfully be excluded under the laws of Fiji.
Orders from Cyber Food partner Vendors must normally be placed through the Cyber Food website or app.
Cyber Food may, at its discretion, assist with an order from a non-partner business through an approved support channel. Before the order is purchased, we will provide or confirm the available item information and the estimated total, which may include the purchase price, delivery fee, service fee, waiting-time fee, and other disclosed costs.
An assisted order is confirmed when you accept the quoted charges and complete any required payment or verification. Because Cyber Food may purchase the item on your behalf after confirmation, cancellation may not be available once the purchase has been made. Your legal rights in relation to faulty, unsafe, misdescribed, or undelivered items remain unaffected.
An electronic order summary or cost breakdown will be available on request. The original seller’s receipt will be provided where it is available to Cyber Food.
Images on the Platform are for illustration. Appearance, portion, presentation, packaging, ingredients, and availability may vary from the image or description.
Vendors are responsible for providing menu and ingredient information and for preparing orders. If you have a food allergy, intolerance, religious requirement, or other dietary concern, review the available information and contact the Vendor or Cyber Food before ordering. We cannot guarantee that a Vendor’s kitchen, preparation area, or delivery packaging is free from allergens or cross-contact.
Do not consume an item that you reasonably believe is unsafe or not what you ordered. Contact customer support promptly.
Promotional codes, vouchers, discounts, and account credits may have additional conditions displayed with the offer. Unless the offer states otherwise:
they are valid only for the stated period, customers, locations, Vendors, items, and payment methods;
they cannot be exchanged for cash or transferred;
only one promotion may be used per order;
minimum-spend and maximum-discount limits may apply;
delivery, service, or payment-processing fees may be excluded; and
cancelled, refunded, fraudulent, or abusive orders may cause the promotion or credit to be reversed.
We may correct or withdraw an offer affected by an obvious error, misuse, technical problem, or suspected fraud, while respecting confirmed orders and applicable law.
If you submit a review, photo, comment, or other content, it must be truthful, relevant, lawful, and based on your genuine experience. It must not infringe another person’s rights, contain unlawful or abusive material, disclose another person’s private information, mislead users, impersonate anyone, or promote spam or fraud.
You retain ownership of your content. You grant Cyber Food a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and use that content for operating, improving, and promoting the Platform, subject to our Privacy Policy and applicable law.
We may moderate or remove content that breaches these Terms or the law.
You must not:
use the Platform for unlawful, fraudulent, harmful, or abusive activity;
interfere with the Platform’s operation or security;
attempt to access another user’s account or non-public systems;
use automated tools to scrape, copy, overload, or disrupt the Platform without permission;
misuse promotions, refunds, payment methods, or customer-support channels;
threaten, harass, discriminate against, or endanger Vendors, couriers, staff, or other users; or
use Cyber Food’s name, branding, or content without permission.
We may restrict, suspend, or close an account where reasonably necessary because of a material breach of these Terms, non-payment, fraud, abuse, safety risk, unlawful activity, or repeated misuse of the Platform.
Where appropriate, we may give notice or an opportunity to address the issue. We may act immediately where necessary to protect a person, prevent fraud, comply with law, or protect the Platform.
Account suspension or closure does not remove payment obligations or rights that arose before suspension or closure.
The Platform and its software, design, text, graphics, trademarks, logos, and other Cyber Food content are owned by or licensed to Cyber Food and are protected by applicable intellectual-property laws.
You may use the Platform only for personal, lawful ordering and related purposes. You may not copy, modify, distribute, sell, license, reverse-engineer, or commercially exploit any part of the Platform except with our written permission or where the law permits it.
Vendor names, logos, menu images, and other third-party materials belong to their respective owners.
The Platform may contain links to or integrations with third-party services, including payment providers, maps, app stores, and Vendor websites. Those services may have their own terms and privacy practices. Cyber Food is not responsible for a third-party service except to the extent required by law or where the issue was caused by our own act or omission.
We aim to keep the Platform accurate, secure, and available, but we do not guarantee uninterrupted or error-free operation. We may maintain, update, change, or temporarily suspend features where reasonably necessary.
To the extent permitted by law, we are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, natural disaster, road closure, utility or telecommunications failure, civil disturbance, government action, or widespread system outage.
Nothing in these Terms excludes or limits liability, consumer guarantees, or remedies that cannot lawfully be excluded or limited under Fiji law.
Subject to that protection, Cyber Food is responsible for loss or damage that is a reasonably foreseeable result of our breach of these Terms or our failure to use reasonable care. We are not responsible for loss caused by:
inaccurate information supplied by the customer;
a customer’s failure to secure an account or follow reasonable instructions;
a Vendor’s act or omission outside Cyber Food’s reasonable control;
an event outside our reasonable control; or
use of the Platform for commercial or business purposes unless agreed in writing.
We do not exclude liability for fraud, wilful misconduct, personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
Our collection and use of personal information is explained in the Cyber Food Fiji Privacy Policy. By using the Platform, you acknowledge that delivery requires us to share relevant order, contact, and location information with the Vendor, courier, payment provider, and service providers involved in fulfilling or supporting the order.
We may update these Terms to reflect changes to our services, business practices, or legal obligations. The updated Terms will be posted with a new effective date. Where a change is material, we will provide reasonable notice through the Platform or another appropriate channel.
Changes will not unfairly alter rights or obligations relating to an order already confirmed before the change took effect.
These Terms are governed by the laws of Fiji.
If you have a complaint, please contact us first so we can try to resolve it promptly. Nothing in these Terms prevents either party from using any court, regulator, consumer-protection body, or dispute-resolution process available under Fiji law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
